All sales, property managers, rental and letting agents employed by a registered Broker office must also be registered on the
Brokers’ Register.
The documents required are:
- Two (2) passport size photographs
- A copy of their passport
- A copy of their residence visa
- A copy of their labor card (the occupation must be the same as on their employment visa with the same sponsoring company and employed by the registered office (not employed by another business even if the same sponsor)
- The application must be on the approved form and signed by the company sponsor
The Division shall issue a Broker with a card bearing his name and address, in addition to his registration number. The Broker shall
include his name and registration number in the Register in all correspondence and reports issued by him. This includes all listing
agreements, Buyers’ Agent agreements, sales contracts transacted by him, advertising and all marketing materials.
Every Broker registered in the Register shall apply to the Division for annual renewal of his registration in the Register. The renewal application shall be submitted to the Division on the prescribed form at least thirty days prior to the expiry date of the registration certificate. The Division shall renew the Broker's registration in the Register after verifying compliance with the renewal conditions.
Real Estate Agents, Brokers, Realtors, Estate Agents who are operating outside of Dubai cannot be registered on the Brokers' Register. This also includes from free-zones and off-shore entities.
A Broker office and a developer who is also a registered broker, and the developer is wanting to use an Agent / Broker external to Dubai to market Dubai properties for sale, then the Registered Broker office may apply for a "Special Permit" to use this Agent. Law No. (8) applies which stipulates that a developer may not use an unregistered broker. If the developer is a registered Broker, then the application can be made to RERA for consideration with the following documents attached:
- The Developer's Broker Registration certificate
- The "external agent's" official license from their government certified and attested in the UAE acceptable format
- A certified copy of the Chamber of Commerce membership
- A copy of the agreement between the Agent and the Developer
- An undertaking from the Dubai Registered Broker (usually a Developer in this case but may be an Agent)
- A company profile from the external agent, attested copies of the passports and residency of each of the directors of the external company.
- The Dubai Registered Broker must be prepared to accept full responsibility and liability for errors, omissions, mistakes made by the external Agent.
This can only be acceptable for the Buyer’s funds being payable into the project trust account in Dubai.
